Daniel Mulligan v. Pacific Bell

Alameda Superior Court Case Number 837113-5

Case Type: Class Action - Consumer Fraud, Unfair Business Practices

Status: Settled on the eve of trial for up to $16 million

In this class action lawsuit, The Sturdevant Law Firm and co-counsel Steyer Lowenthal Boodrookas Alvarez and Smith achieved a settlement of up to $16 million on behalf of customers who paid the phone company a monthly fee for a wiring repair insurance plan ("Wirepro"). The lawsuit alleged that Pacific Bell intentionally misled its customers who were tenants by concealing from them that fact that they didn’t need the insurance plan because their landlords are legally required to maintain and repair the telephone wiring. The settlement was achieved on the eve of trial and was approved by the Court in December of 2004.
