Regents of the University of California, et al.United States District Court, Eastern District of California - Case Number 2:07-CV-01488-FCD-EFBCase Type: Civil Rights, Title IX, Gender EquityStatus: Settlement Preliminarily ApprovedThe University of California, Davis (“UC Davis”), Plaintiffs Kelsey Brust, Jessica Bulala, and Laura Ludwig, current and former students, have reached agreement in the class action lawsuit based on the alleged unequal opportunities available for women’s participation in varsity sports. The settlement sets out a 10 year plan for UC Davis to reach specific proportions of male and female athletes by the 2019-20 school year. The settlement also provides additional financial support for club sports at UC Davis. On August 11, 2009, Judge Frank Damrell preliminary approved the settlement.
The lawsuit, filed by women student athletes alleged that UC Davis violated Title IX, the Equal Protection Clause of the U.S. Constitution and state civil rights laws by failing to provide women athletics opportunities and scholarships at UC Davis that are equal to those provided to male students relative to the respective enrollments of each sex, despite interest in sports like women’s field hockey, wrestling, and rugby. On Friday October 24, 2008, U.S. District Court Judge Frank Damrell granted The Sturdevant Law Firm’s motion for class certification and appointed SLF, along with co-counsel Equal Rights Advocates and Equity Legal, as class-counsel in lawsuit on behalf of three University of California Davis (UC Davis) women students against the university in United States District Court, Eastern District of California.
The elimination of women’s wrestling is the subject of another civil rights lawsuit handled by The Sturdevant Law Firm and Equal Rights Advocates against UC Davis which is presently pending in federal court in Sacramento (Mansourian et al. v. Regents of The University of California at Davis).
