Decker v. Hewlett Packard Company

U.S. District Court, Northern District of California Case Number CV 09-0295 PVT

Case Type: Consumer fraud

Status: Class action filed January 22, 2009

This complaint, filed on behalf of a national class, alleges that several Hewlett Packard (HP) laptops are improperly designed because the internal Wireless Device is inherently defective and makes it impossible for users to use their laptop for internet, which, in many cases, is the purpose for which they were used. The complaint also alleges that when faced with thousands of consumer complaints for its defective Wireless Device, HP systematically refused to warn or advise consumers about the defect. In Plaintiff Katherine Decker’s case, for example, HP refused to take responsibility for the failure of the wireless device, claiming that the device had suffered water damage. Further evaluation, however, showed that her computer had never been damaged by water.
